This Notice of Privacy Practices applies to the clinical services provided by SOMA Trauma Healing Center ("SOMA," "we," "us"). It explains how we may use and share your protected health information (PHI) and the rights you have. It is separate from our website Privacy Policy, which covers only information collected through somatrauma.com. We are required by law to protect your PHI, to give you this notice, and to follow the terms of the notice currently in effect.
How We May Use and Disclose Your Information
Treatment. We use your health information to provide and coordinate your care, including sessions, treatment planning, and, when appropriate, consultation with other providers involved in your care.
Payment. We may use your information to bill you and to document services for superbills or out-of-network reimbursement you submit to your insurer.
Health care operations. We may use your information to run the practice, improve quality, train supervised clinicians, and support administrative functions.
As required or permitted by law. We may disclose information when the law requires it, including to prevent a serious threat to health or safety, to report suspected abuse or neglect, in response to a court order, or for public health and safety purposes.
Uses That Require Your Written Authorization
Most uses and disclosures of psychotherapy notes, any use for marketing, and any sale of your information require your written authorization. You may revoke an authorization in writing at any time, and we will stop using or sharing your information for that purpose going forward.
Your Rights
You have the right to:
- Access and copy your health record, and request it in an electronic format when available.
- Request an amendment if you believe information in your record is incorrect or incomplete.
- Request restrictions on certain uses and disclosures. We will accommodate a request to restrict disclosure to a health plan for services you paid for in full out of pocket.
- Request confidential communication by a specific method or at a specific location.
- Receive an accounting of certain disclosures we have made.
- Receive a paper copy of this notice on request, even if you agreed to receive it electronically.
- Be notified if a breach of your unsecured health information occurs.
Our Responsibilities
We are required to keep your health information private, to give you this notice of our legal duties and privacy practices, and to follow the terms of the notice in effect. We will not use or share your information other than as described here unless you tell us we can in writing.
Changes to This Notice
We may change this notice, and the changes will apply to all information we hold. The revised notice will be available in our office and on this website. The effective date at the top reflects the latest revision.
How to File a Complaint
If you believe your privacy rights have been violated, you may file a complaint with us using the contact information below. You may also file a complaint with the U.S. Department of Health and Human Services, Office for Civil Rights, by mail to 200 Independence Avenue SW, Washington, D.C. 20201, by calling 1-877-696-6775, or online at hhs.gov/ocr/complaints. We will not retaliate against you for filing a complaint.
